(“Utech,” “we,” “us,” or “our”) through its UNIQ TMS services, software applications (including web-based and mobile applications), and websites (including uniqtms.com) (together, the “Services”).
BY REGISTERING ON, ACCESSING, OR USING THE SERVICES, YOU CONSENT TO THE COLLECTION, TRANSFER, STORAGE, DISCLOSURE, AND USE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.
Utech may modify this Privacy Policy from time to time, so please consult this Privacy Policy regularly. Your continued use of the Services after any modification to this Privacy Policy will constitute your acceptance of such modification.
This Privacy Policy applies to users and customers of the Services (collectively, “users” or individually, “you” or “your”), including freight shippers, logistics providers, facility operators, carriers, commercial drivers, and dispatchers. It does not apply to the use of any third party websites, applications, features, platform, or other product or service (“Third Party Services”) that integrate with or can be accessed through the Services, including, but not limited to, any links to third party websites or externally-facing URLs provided through the Services. This Privacy Policy applies only to information collected through our online Services and does not apply to information collected offline.

Utech collects information about you when you use the Services, and through other interactions and communications you have with us in connection with the Services. This includes collection at the time you download a mobile application, use a website or web-based application, create or register your UNIQ TMS account, and when you otherwise use the Services.

Except as described above, we do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice and you consent to the sharing. The term “outside parties” does not include hosting partners and other parties who assist us in operating our Services, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, including responding to a court order, subpoena, search warrant, or other law enforcement request; to enforce our policies; to enforce or apply our Terms and Conditions of Use, or to protect ours or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
Your information collected through the Services may be stored and processed in the United States and any other country in which Utech, its affiliates, or service providers operate. Please note that different countries may have different data protection laws, and as such, we may transfer information, including your personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. By registering for and using the Services, you consent to this transfer of information and the use and disclosure of information about you as described in this Privacy Policy.
If Utech is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be shared, sold and/or transferred as part of that transaction.
We implement commercially reasonable security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks using industry standard firewall and password protection, and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be accessed only as stated above.
However, Utech cannot guarantee the security of any information you transmit to Utech or guarantee that the information will not be accessed, disclosed, altered, or destroyed. Further, Utech is not responsible for the functionality, privacy, or security measures of any other organization.
We will retain your information as long as necessary to provide you with the Services, to maintain your account for as long as your account is active, or as otherwise needed to operate our business. When you close your account, we may continue to communicate with you about our Services, give you important business updates that may affect you, and let you know about products and services that may interest you, unless you have opted out of receiving marketing communications. We may also continue to use your information for business purposes and to improve our offerings or in some cases to develop new ones. We will retain and use your information as required by applicable regulations and Utech’s records and information management policies, to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete any outstanding transactions, and for the detection and prevention of fraud.
You may choose to sync, link, or otherwise connect Third Party Services, including your third party logistics accounts and email accounts, with your UNIQ TMS account. In order to do so, we must access your online account with your third party logistics provider or email provider. We will request your username, password, and any other login data necessary to enable access. We use this information to update and maintain the account information you download, to assist with the download process, and to enhance the Services we may provide in the future.
We work with other companies and developers to offer you products and services. Sometimes Utech may let you know about the service or product, or another company may let you know about the service or product. If you choose to accept these products and services, by providing your consent to either the third party or to us, you permit us to exchange your information, including your personal information, with the third party.
If you are a registered user of our Services, you may access, correct, delete, or modify the information you provided to us and associated with your account, by logging into your account settings. You may also unsubscribe from e-mail communications by clicking the “Unsubscribe” link provided in such communications. For SMS messages, follow the instructions in the message or settings to discontinue the service. Subject to your control, our mobile applications may send push notifications to your mobile device. If you are receiving push notifications and no longer wish to receive these types of communications, you may turn them off at the device level.
If your account is terminated or otherwise deactivated, whether by Utech, yourself, or anyone else, your data (including your profile information) and content will no longer be accessible through your account, but that data and content may persist and appear within the Services. Please note that search engines and other third parties may still retain copies of your public information, such as your user profile information and public posts, even after you have deactivated your account.
Mobile platforms including iOS and Android have different permission systems for obtaining your consent to collection of location information. The permissions requested by the Services include permission to collect your location data for the purposes described above. This permission may enable Utech to collect your location data even when the mobile application is not running in the foreground or background of your device. Turning off the application may not result in disabling the location data collection. Additionally, disabling our collection of precise location from your device will not limit our ability to derive approximate location from your IP address. You will not be able to use certain features of functionalities of the Services if you do not permit location data collection.
In an attempt to provide you with increased value, we may include third party links on our Services. These linked sites and services have separate and independent privacy policies. Utech is not responsible for the practices employed by any websites or services linked to or from our Services, including the information or content contained within them. Please remember that when you use a link to go from our Services to another website or service, our Privacy Policy does not apply to those third party websites or services. Your browsing and interaction on any third party website or service, including those that have a link on our website, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible and do not have control over any third parties that you authorize to access your content. If you are using a third-party website or service and you allow them to access your content, you do so at your own risk.
